However, for some time now, we have not been advising on the agreement of an arbitration clause in new contracts because it has become apparent that the proceedings often become more expensive than court proceedings and drag on. In our opinion, the somewhat stricter procedural rules in court proceedings have advantages here, at least when the parties are very divided. In mediation, our focus is on working out a diplomatic solution in which both parties can face each other and find an acceptable solution or even continue to work together. The firm has a high ethical standard, negotiates hard but fair and never works “below the belt”. Therefore, the firm has a good reputation among its colleagues and among law firms well known in ET law.
